Terms of Service

1. Acceptance of Terms
By booking any rental from Tater Totes ("Company," "we," "us," or "our"), you ("Customer") agree to be bound by these Terms of Service in full. If you do not agree, do not proceed with a booking.
2. Services Provided
Tater Totes provides short-term rental of plastic moving totes, hand trucks, and related moving supplies for residential and commercial use within Massachusetts and New Hampshire.
3. Booking & Payment
- All bookings require full payment at time of reservation via our secure Stripe checkout.
- Prices are displayed in USD and are subject to applicable state sales tax.
- A promo code, if applicable, will be applied at checkout. Codes cannot be combined.
- By completing a booking, you authorize Tater Totes to save your payment method on file for incidental charges as described in the Equipment Rental Agreement.
4. Rental Duration & Weekly Billing
- All rentals are billed in full-week increments. There are no daily or hourly rates.
- The base package price covers the first 7 days of the rental period.
- A 1-day grace period applies at the end of each billing week. If your rental runs exactly 1 day into a new week (e.g., 8 days, 15 days, 22 days), no additional weekly charge is applied for that single day.
- If your rental extends 2 or more days into a new week, a full extra-week fee is charged for that period.
- Examples (The Spud package — $120/wk + $45/extra wk):
- 7 days → 1 week → $120
- 8 days → 1 week (grace day) → $120
- 9 days → 2 weeks → $165
- 14 days → 2 weeks → $165
- 15 days → 2 weeks (grace day) → $165
- 16 days → 3 weeks → $210
- The exact week count and any applicable grace period will be shown in your order summary before payment is collected.
5. Cancellation & Refunds
- Cancellations made more than 48 hours before the rental start date are eligible for a full refund.
- Cancellations within 48 hours of the start date are non-refundable.
- Tater Totes reserves the right to cancel a booking due to inventory or logistical issues, in which case a full refund will be issued.
6. Use of Equipment
All rented equipment is for lawful moving and storage purposes only. Customers may not sublet, lend, or transfer equipment to third parties. Equipment must be returned in the same condition as delivered, less normal wear and tear.
7. Liability Limitation
Tater Totes is not liable for any indirect, incidental, or consequential damages arising from the use of our equipment or services. Our maximum liability shall not exceed the amount paid for the rental in question.
8. Modifications
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
9. Governing Law
These Terms of Service are governed exclusively by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Commonwealth of Massachusetts.
Privacy Policy

1. Information We Collect
When you use Tater Totes, we may collect:
- Personal information: name, email address, phone number, delivery address
- Payment information: processed securely via Stripe — we never store raw card numbers
- Usage data: booking history, rental dates, package selections
2. How We Use Your Information
- To process and fulfill your rental booking
- To communicate with you about your order (confirmations, reminders, follow-ups)
- To charge incidental fees (unreturned totes, damaged equipment) per your signed authorization
- To improve our services and website experience
3. Payment Security
All payment processing is handled by Stripe, a PCI DSS Level 1 certified payment processor. Tater Totes stores only a tokenized reference (Stripe Customer ID and Payment Method ID) — never raw card numbers or CVV data. Your card information is encrypted and stored securely on Stripe's infrastructure.
4. Card on File
With your explicit written authorization at checkout, we may save your payment method on file to charge applicable fees outlined in the Equipment Rental Agreement. This authorization can be revoked by contacting us directly, provided no outstanding charges remain.
5. Data Sharing
We do not sell or share your personal information with third parties for marketing purposes. We may share data with:
- Stripe (payment processing)
- Service providers necessary to fulfill your rental
- Law enforcement if required by law
6. Data Retention
We retain your personal data for as long as necessary to fulfill the purposes outlined above, or as required by applicable law. You may request deletion of your data by contacting us at any time.
7. Your Rights
Depending on your state of residence, you may have rights to access, correct, or delete your personal data. Contact us to exercise these rights.

Equipment Rental Agreement
Effective Date: June 2026 — This agreement is entered into at the time of booking.
⚠️ Important: By completing a booking and checking the authorization checkbox at checkout, you ("Customer") enter into a binding Equipment Rental Agreement with Tater Totes. Please read this document carefully before booking.
1. Rental Equipment
Tater Totes agrees to rent to Customer the plastic moving totes, hand trucks (dollies), and associated supplies selected at checkout (collectively, "Equipment") for the rental period specified in the booking confirmation.
2. Delivery & Pickup
Tater Totes will deliver Equipment to the address provided at checkout on the agreed rental start date and will retrieve Equipment on the agreed rental end date. Customer is responsible for ensuring Equipment is accessible and ready for pickup at the agreed time.
3. Property Access Right
Customer expressly grants Tater Totes and its authorized delivery drivers permission to enter the delivery address provided at checkout for the sole purposes of (a) delivering the rented Equipment at the start of the rental period and (b) retrieving the rented Equipment at the end of the rental period. This access right is limited to reasonable hours and solely to the above-stated purposes. Customer warrants that they have the legal authority to grant such access to the stated property.
4. Rental Duration & Billing Policy
Rentals are billed in full-week increments as follows:
- The package base price covers the first 7 days of the rental period.
- 1-Day Grace Period: If the rental runs exactly 1 day beyond a full week (8, 15, 22 days, etc.), no additional week is charged. The customer retains the equipment for that extra day at no cost.
- If the rental extends 2 or more days into a new billing week, a full extra-week fee applies for that period.
- The applicable week count, grace period status, and total price are confirmed in the Stripe checkout summary prior to payment. The Customer agrees that the price shown at checkout is final and binding.
- Equipment must be made available for pickup by Tater Totes on or before the confirmed return date. Failure to do so may result in additional weekly charges if the rental extends into a new billing period.
5. Customer Responsibilities
- Keep all Equipment secure and in good condition throughout the rental period
- Return all Equipment by the agreed pickup date
- Not move Equipment outside the agreed service area (MA and NH) without prior written approval
- Immediately report any Equipment damage or loss to Tater Totes
6. Fees & Penalties
- Unreturned Totes: $50.00 per missing tote, charged at time of pickup
- Unreturned Dollies: $75.00 per missing dolly, charged at time of pickup
- Damaged Totes: $50.00 per damaged tote
- Damaged Dollies: $75.00 per damaged dolly
- Out-of-Bounds Pickup: $500.00 flat-rate fee for retrieval outside service area without prior approval
- Normal wear and tear (minor scuffs, light dirt) is not charged
7. Card on File Authorization
By checking the authorization box at checkout, Customer explicitly authorizes Tater Totes to:
- Securely save Customer's payment method on file via Stripe
- Automatically charge the saved payment method for any fees specified in Section 5 above
- Charge said fees without additional notice if Customer fails to dispute within 48 hours of pickup
The exact authorization text agreed to by the Customer is recorded and timestamped at the time of checkout.
7. Out-of-Bounds Policy
Equipment must remain within the service area of Massachusetts and New Hampshire at all times. Moving Equipment outside these states without prior written approval from Tater Totes will result in a $500 flat-rate retrieval fee in addition to any other applicable charges.
8. Sales Tax
Sales tax is calculated based on the Customer's delivery ZIP code at the applicable state rate. New Hampshire deliveries are exempt from sales tax. Massachusetts deliveries are subject to the 6.25% state rental tax rate.
9. Governing Law
This Equipment Rental Agreement is governed exclusively by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within the Commonwealth of Massachusetts. Customer consents to personal jurisdiction in such courts.
10. Entire Agreement
This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior negotiations, representations, or agreements.
